Regulated Activities

BCMGlobal’s principal business is the provision of asset services generally. BCMGlobal provides loan management services to lenders and/or companies that have a legal or economic interest in loans (“Loan Owners”). BCMGlobal may also provide loan origination services to lenders and may hold the legal interest in loans as a trustee. These activities are regulated by the Central Bank of Ireland.

Central Bank Codes

The services of BCMGlobal are subject to the Central Bank of Ireland’s Consumer Protection Code 2025; (CPC 2025) and Lending to Small and Medium – Sized Enterprises; (SME) Regulations. These codes and legislation offer protection to borrowers and can be found on the Central Bank’s website www.centralbank.ie

Fees and Charges

In general, BCMGlobal does not apply charges directly to the customer for services provided by it. However Central Bank of Ireland-approved Lender/Loan Owner Section 149 Consumer Credit Act, (as amended) fees and charges may apply in certain instances.

Your Personal Data

Under Data Protection Legislation (by which we mean Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“the GDPR)) or any replacement legislation applicable in Ireland from time to time including the Data Protection Acts 1988 to 2018 and, where applicable, any guidance and codes of practice issued by a supervisory authority or by the Article 29 Working Party (or any replacement group from time to time), BCMGlobal will generally act as a Data Processor when managing your personal data. The Data Controller of your personal data will generally be your Loan Owner. BCMGlobal processes your data as directed by the Data Controller.

Where BCMGlobal is the Loan Owner and is a Data Controller it will hold your personal data and may process such data and transfer this data to its affiliates and servicing agents in accordance with its privacy policy set out at: https://www.bcmglobal.com/privacy-notice/.

BCMGlobal is required under the Data Protection Acts to keep your personal data secure from unauthorised access, disclosure, destruction or accidental loss.

Conflicts of Interest

It is the policy of BCMGlobal to avoid any conflict of interest in connection with services provided by it. Where an unavoidable conflict of interest arises BCMGlobal will address such conflict by disclosing the nature of the conflict arising and putting in place mitigants and controls to ensure that any identified conflict is being effectively managed.

Where you Default

Where you default in your obligations to the Loan Owner, BCMGlobal may notify you of such default and may ask you to take action to remedy it to the satisfaction of the Loan Owner. At any time after such default (subject to the terms and conditions relevant to the product or service and to any applicable Central Bank code, consumer credit law, legislation or regulation) BCMGlobal, on behalf of the Loan Owner, may seek to enforce your obligations to the Loan Owner of your loan through legal proceedings or through the enforcement of any guarantee or security given in respect of your obligations to the Loan Owner.

Complaints

We aim to treat all our customers in a fair and professional manner, but if you have any complaints about our service, please let us know. We will investigate your complaint fully and seek to ensure that any issues are remedied so that they do not happen again.
